NOTICE
Jim Huggins in Smith County just informed me that the
TCEQ has finally finished revising their proposed rules
revisions (after public comment). The final version has
been sent to the TCEQ Commissioners for approval on
August 20, and will probably go into effect on September
11. (Except for those parts that go into effect on
Sepember 1, 2009). If you are interested you can find the
final version under "pending adoptions" in the TCEQ
rules section. There are only 270 pages of very intriguing
reading to quote Jim. Maybe we should take a look.
CHANGES TO SEPTIC/AEROBIC REGULATIONS EFFECTIVE 9/11/2008
1. Homeowners not required to have maintenance contract after first two years.
2. Homeowners not required to have training.
3. Homeowners not required to send in reports.
4. No changes to current cluster system rules (previously proposed changes were
eliminated.)
5. Creates Maintenance Provider license and Maintenance Technician license.
A. Not effective until 9/1/2009
B. Existing Maintenance providers appear to be "grand-fathered" and will not have to
take the new 24 hour course.
6. Manufacturer certification of maintenance providers no longer required.
7. Maintenance Contracts and service reports must contain the business address and
phone number of the Maintenance Provider.
8. Permits may now have "conditions". ( i.e. ATU inspections every month, or every
week.)
9. Restaurants and other buildings with food service establishments must have twice the
area required for "treatment facilities".
10. Designs for restaurants must use 1200 mg/l (after the grease interceptor) for all
wastewater from the facility (including effluent from the bathrooms, per James McCain at
TCEQ).
11. The designer should consider whether flow-equalization is necessary.
12. OSSF plans for buildings larger than 5000 sq. ft. are no longer required to be
designed by engineers.
13. D.R.s can inspect existing aerobic systems at any time.
14. Site Evaluations and designs. In addition to existing requirements, the design planning
materials must include:
A. soil boring locations
B. slope direction and percentage of slope
C. 100-year floodplain boundaries, if one is on the site, or a statement that the site is not
in a 100 year flood plain
D. All features and their required separation distances must be shown on the design.
15. There are now minimum ATU capacity requirements for various house sizes.
A. 3-bedroom - 400 gpd
B. 4-bedroom - 480 gpd
C. 5-bedroom - 600 gpd
D. 6-bedroom - 720 gpd
E. 7-bedroom - 840 gpd
F. 8-bedroom - 960 gpd
G. 9-bedroom - 1080 gpd
16. Construction changes:
A. Tanks must have sealed risers, watertight caps, and "prevention of unauthorized
access."
B. Leak testing may be performed. (appears to be at inspector's option.)
C. All pipe under internal pressure (except drip tubing) must be SCH 40.
D. Piping under sidewalks and driveways must be sleeved.
17. Aerobic system permits transfer automatically when property is sold.
18. Overhead and underground easements have new set-back requirements.
